Can international students work in China?

Not in ordinary employment. International students in China may take part in work-study activities, but they may not take a job, run a business or do other for-profit activity. Off-campus work-study or an internship is allowed only after your school approves it and the exit/entry administration adds it to your residence permit.

What the rules say

Three texts cover this, and they fit together.

The Ministry of Education's rule for schools. Order No. 42, Article 30, says international students may take part in work-study activities during their studies, "but may not take employment, do business or engage in other for-profit activities". It adds that detailed rules on work-study are to be set separately by the education authorities with other departments.

The entry and exit regulations. Article 22 says a holder of a residence permit for study who wants to do off-campus work-study or an internship must, with the school's approval, apply to the exit/entry administration to have the location and duration written into the residence permit. Without that entry on the permit, off-campus work-study and internships are not allowed.

The Exit and Entry Administration Law. Article 43 lists what counts as unlawful employment. One of the three cases is a foreign student who works in breach of the work-study rules, or beyond the scope of jobs or the time limit those rules prescribe.

How to get the endorsement

The National Immigration Administration's service guide for residence permits describes the step. A student with a study residence permit who needs work-study or an off-campus internship submits letters from the school and from the internship unit agreeing to it, and applies to the exit/entry administration for an annotation on the residence permit.

So the order is: agreement from the school, agreement from the place you will work or intern, then the application to the exit/entry administration. You start only after the permit carries the annotation.

What the official pages do not say

The law says the education authorities are to set the scope of jobs and the limit on working time for foreign students. The pages this site has read do not state a number of hours or a list of permitted jobs. Ask your university's international student office what applies locally before you agree to any work.

Can I work on an X2 visa?

The endorsement described above is added to a residence permit for study. X2 holders, who study for 180 days or less, do not have a residence permit, so that route is not open to them.

Is a campus job treated the same way?

Article 22 of the regulations is about off-campus work-study and internships. For work-study on campus, the Ministry of Education rule applies: work-study is allowed, employment is not. Your university decides what on-campus work-study it offers.

What is the penalty for working illegally?

The Exit and Entry Administration Law treats work outside the work-study rules as unlawful employment. Penalties are set in the law's chapter on legal liability; read the law's text for the current provisions.

Can I stay and work after I graduate?

A study residence permit covers study. Working in China requires a work permit and a work-type residence permit under Article 41 of the law. This page does not cover how graduates qualify for those.
